BROWSE MD, LLC CONSUMER AGREEMENT AND
PRIVACY POLICY
BrowseMD.com is compiled and published by Browse MD, LLC
(hereinafter referred to as Browse MD) as a reference source of demographic and
professional information on individual licensed physicians, medical centers,
and insurance companies in the State of Georgia. The only permitted uses of
Browse MD health care directory searches are for (i) the personal convenience
of members of the general public to facilitate quick access to information
about physicians with whom they may be consulting regarding medical services,
(ii) individual physicians or their staff to view their personal listings or
those of colleagues for professional purposes such as patient referrals, and
(iii) the personal convenience of members of the general public having access
to medical centers and insurance companies functioning in the State of Georgia.
Browse MD reserves the right and hereby notifies you that it will be
monitoring all use of this website for compliance with the terms and conditions
of this agreement - including the permitted use described above. Browse MD
shall block your use of this product indefinitely should we determine, at our
sole discretion, that your use is beyond that permitted above. The Browse MD
physician, medical center, or insurance company directory, nor any of its data,
or other constituent elements may be downloaded, republished, resold, or
duplicated, in whole or in part, for any purpose other than the personal uses
permitted above.
The use of Browse MD Physician listings by hospitals, managed care
organizations, PPOs or other commercial entities for purposes of verifying the
credentials of physicians is prohibited. The database of physician information
for Browse MD does not contain sufficient information with which to verify
physician credentials under the standards of the Joint Commission (JCAHO),
National Committee for Quality Assurance (NCQA) or the Utilization Review
Accreditation Committee (URAC). For further information about verifying
physician credentials, please contact Georgia’s Composite State Board of
Medical Examiners.
DISCLAIMER OF WARRANTIES AND LIABILITIES:
Browse MD undertakes reasonable efforts to keep the information
contained in the Browse MD physician, medical center, and insurance company
directory accurate. However, because Browse MD compiles such information from
numerous and varied sources and may experience reporting and processing errors
or delays. The material included in this Web site is for informational purposes
only.
Inclusion of a physician, medical center, or insurance company is
not and does not imply a Browse MD referral, endorsement or recommendation, nor
does the omission of any individual indicate Browse MD disapproval.
BROWSE MD FUNDING POLICY AND SUBMISSION PROCEDURES
Browse MD is funded through monies (i) obtained from Third Party
Sponsor Ads, (clearly displayed with the word “Sponsor”), (ii) from Third Party
Sponsors of Browse MD Health Fairs and related activities, (iii) and from
Listed Service Providers (Physicians, Hospitals & Medical Centers, and
Insurance Companies) which make the availability of their services effortless
for consumers -and who agree to comply with the Browse MD Business and Ethics
Policies. Browse MD uses monetary funding for purposes of purchasing necessary
equipment and products which further the advancement of Browse MD Healthcare
Solutions.
THE SITE DOES NOT PROVIDE MEDICAL ADVICE:
The contents of the Browse MD Site, such as text, graphics, images,
and other material contained on the Browse MD Site ("Content") are for
informational purposes only. The Content is not intended to be a substitute for

2. The satisfaction of any government regulations requiring
disclosure of information on prescription drug products or the approval or

In no event shall Browse MD, its licensors, its suppliers, or any
third parties mentioned on the Browse MD Site be liable for any damages
(including, without limitation, incidental and consequential damages, personal

Browse MD collects Non-Personal Information about your use of our

USER SUBMISSIONS:
The personal information you submit to Browse MD is governed by this
Agreement.
You agree that you will not upload or transmit any communications or
content of any type to the Public Areas that infringe or violate any rights of
any party. By submitting communications or content to the Public Areas, you
agree that such submission is non-confidential for all purposes.
If you make any such submission You agree that you will not send
or transmit to Browse MD by email, (including through the email addresses
listed on the "Contact Us" link) any communication or content that infringes or
violates any rights of any party. If you submit any business information, idea,
concept or invention to Browse MD by email, you agree such submission is
non-confidential for all purposes.
If you make any submission to a Public Area or if you submit any
business information, idea, concept or invention to Browse MD by email,
you automatically grant—or warrant that the owner of such content or intellectual
property has expressly granted—Browse MD a royalty-free,
perpetual, irrevocable, world-wide nonexclusive license to use, reproduce,
create derivative works from, modify, publish, edit, translate, distribute,
perform, and display the communication or content in any media or medium, or
any form, format, or forum now known or hereafter developed. Browse MD may
sublicense its rights through multiple tiers of sublicenses. If you wish to
keep any business information, ideas, concepts or inventions private or
proprietary, do not submit them to the Public Areas or to Browse MD by email.
We try to answer every email in a timely manner, but are not always able to do
so.
Use of Participant's Contact Information: Participant agrees that
Browse MD and its affiliates may use any contact addresses and numbers,
including email addresses, telephone and fax numbers, provided to Browse MD by
Participant or otherwise used by Participant, to contact Participant for any
customer service or business purposes.
INDEMNITY:
You agree to defend, indemnify, and hold Browse MD, its officers,
directors, employees, agents, licensors, and suppliers, harmless from and
against any claims, actions or demands, liabilities and settlements including
without limitation, reasonable legal and accounting fees, resulting from, or
alleged to result from, your violation of these Terms and Conditions.
JURISDICTION:
You expressly agree that exclusive jurisdiction for any dispute with
Browse MD, or in any way relating to your use of the Browse MD Site, resides in
the courts of the State of Georgia and you further agree and expressly consent
to the exercise of personal jurisdiction in the courts of the State of Georgia
in connection with any such dispute including any claim involving Browse MD or
its affiliates, subsidiaries, employees, contractors, officers, directors,
telecommunication providers, and content providers.
These Terms and Conditions are governed by the internal substantive
laws of the State of Georgia, without respect to its conflict of laws
principles. If any provision of these Terms and Conditions is found to be
invalid by any court having competent jurisdiction, the invalidity of such
provision shall not affect the validity of the remaining provisions of these
Terms and Conditions, which shall remain in full force and effect. No waiver of
any of these Terms and Conditions shall be deemed a further or continuing
waiver of such term or condition or any other term or condition.
NOTICE AND TAKE DOWN PROCEDURES; AND COPYRIGHT AGENT:
If you believe any materials accessible on or from the Site infringe
your copyright, you may request removal of those materials (or access thereto)
from this web site by contacting Browse MD's copyright agent (identified below)
